Please read carefully. This document contains a few different types of documents in one, so that you don't have to sign a bunch of different documents.
a. By signing this document you legally acknowledge that you waive any and all legal rights, including the right to sue Blue Ridge Motion LLC, its staff, affiliates, associates, contractors, owner, property owner, landlord, volunteers, and all others not mentioned here that work with, for and or in cooperation with Blue Ridge Motion LLC. By signing this document you will be agreeing that you understand and have read about the risks involved and are assuming those risks for yourself or for the participant you are in authority over.
b. In this document you are also agreeing to our use of pictures or videos of yourself or participants you are signing for in Blue Ridge Motion LLC's marketing campaigns and advertising on social medias, websites or other platforms for the our own commercial use. This information is not sold or distributed. It is for the sole purpose of marketing our classes, events and gym related activities.
c. This form is also a medical authorization of basic first aid and agreement to allow Blue ridge motion Staff to contact emergency services on your child(s) behalf in the absence of a legal guardian.
d. lastly, this document acts as a payment authorization for future or present transactions. please read through so you may be fully aware prior to signing.
IN CONSIDERATION of the provision of services from Blue Ridge Motion LLC (hereafter "BRM" or "the gym") or any of it's subcontractors and affiliates hosting classes, events or other specialty services within our facility at 598 Music Road NW, Floyd Virginia, 24091 or functions and events, you are agreeing to abide by our terms and are agreeing to be aware of the contents of this document.
I, the undersigned, being at least 18 years of age or older, am agreeing to be held personally responsible for my actions, and am agreeing to abide by the rules and to be subject to this document.
In the event the participant, visitor, and or spectator is under the age of 18 years old, you will be agreeing to and affirming the following.
I, acting as parent, and or legal guardian, am signing on behalf of the participant and am agreeing to be responsible for assuming the risks involved in their participation.
1) BRM Overview: BRM is a parkour, ninja warrior, tumbling, and fitness gym, that offers a wide variety of activities, disciplines, sports and movements, in a wide variety of places, spaces, locations, buildings and venues. We train on many different surfaces and materials, and while the majority of our training takes place in our facility at 598 Music Road NW, Floyd, Virginia 24091, with mats, wooden obstacles, steel bars, training apparatus, safety equipment, and equipment, we do also train outside in many different weather conditions, temperatures, and make use of natural and or man made structures for training, and or recreational purposes.
Our main emphasis is on safety and gradual progressive training for our participants, however our activities do carry inherent risk and some accidents are unavoidable no matter how much you train. These risks should be thoroughly examined and understood clearly prior to participation and prior to signing of this document. Failure to read this document is a violation of our terms and puts full responsibility on you as the signer for not reading through this document. If you are signing for a minor, please communicate this information with them regarding risks, hazards, and for them to respect all the rules and terms we set out in this document. Please read carefully through this form to be aware of the risks you are agreeing to assume upon yourself and or for the underage participant you are signing for.
1.1.) Where we train and offer our services. The majority of our training will be inside our facility, located at 598 Music Road NW, Floyd, Virginia 24091., however we do set up, host, teach and or lead out in: activities, functions, games, classes, open gyms, demonstrations, performances, obstacle courses, seminars, workshops, parties, equipment rentals and training or events that we have listed below that take place in and or at other locations, spaces, venues, and facilities that BRM may or may not have rented or own(ed), such as but not limited to: At a client(s) house(s), at a client(s) property(ies), fair grounds, public event locations, churches, schools, college campuses, juvenile detention centers, recreational centers, community centers, aquatic centers, public schools, private schools, outdoors, public parks, skate parks, public areas, private property(ies) with permission from property owner, summer camps, other camp locations, all around the NRV where appropriate or permissive, and on the property of our rented and or owned facility(ies). In addition to training indoors, we also train outdoors, in the woods, or other open outdoor spaces, in a wide array of conditions; sometimes wet, rainy, foggy, hot, warm, humid, cold, cool, and or even in rain, snow, high wind, and or intense heat, we do the best we can to minimize risks when conditions are such, but certain risks are unavoidable. Surfaces we train on may be indoors and or outdoors, and are often hard surfaces, with training on softer surfaces as well, surfaces like dirt, grass, concrete, asphalt, wood, rubber, foam, mats, cinder block, brick, rock, gravel, stone, composite, or any other number of possible surface types. These surfaces can be slippery and or dangerous when wet, moist or humid, and extreme care must be taken on the participants part when taking part in any of these activities, functions or events at any of our locations, venues or spaces under any and all of the listed conditions.
1.2.) Activities/training. Our training may often include but is not limited to the following activities, disciplines and movements: parkour, freerunning, tricking, circus arts, Lyra, circus hoops, aerial silks, aerial arts, trapeze, climbing, bouldering, rock climbing, scaling, kipping, running, jogging, walking, sprinting, skipping, landing, handstands, headstands, walking on your hands, hopping on your hands, ascending or descending obstacles on your hands or feet, swinging on bars or ledges, flipping off of bars or ledges, flipping off of bars from a swing, climbing bars, swinging from your hands, elbows, shoulders, wrists, arm pits, stomach, back, knees, and or feet, hanging by your hands, elbows, shoulders, arm pits, stomach, back, knees, wrists, heels, or feet, static and or active/dynamic stretching, yoga, Tai chi, kung fu, karate, aikido, boxing, MMA, jumping, striding, leaping, vaulting, hurdling, mantling, flipping, tumbling, gymnastics, dance, rolling, twisting, rotating, crawling, running up walls and or obstacles, running across walls and or obstacles, balancing on rails or other apparatus, exercising full range of motion, kicking, striking, wrestling, fighting, weapon training, obstacle coursing, quadrupedal movements, ninja warrior obstacle training, cardiovascular training, HIIT training, fitness training, personal training, private instruction, weight training, weight lifting, rope climbing, jump roping, crossing gaps greater than 5 feet in distance, crossing obstacles that are higher than 5 feet off the ground, landing, dropping from heights greater than 5 feet, jumping to obstacles that are farther than 5 feet apart, and or any combination of the above mentioned. All these listed activities, disciplines, moves and skills can be done in any order or combination and can even be done in limiting ways such as using only one limb at a time, or only certain parts of your body at certain times, or at varying distances and heights ranging from inches away to several feet. Some activities can even take place as high as 20 feet off the ground, and distances as long as an individual participant can manage.
Participants performing the above mentioned must be performing within their skill range as determined by a CERTIFIED BRM INSTRUCTOR. Participants performing moves, tricks, flips, or other skills outside of their assessed skill levels or without the direction of an instructor are assuming the risk of injury or serious complications and harm, and are taking that responsibility upon themselves to the possible injury of themselves or others. By signing this document, you affirm that you understand these activities can be risky, and dangerous and result in minor to severe harm or even death.
1.3) What we teach. We specialize in teaching parkour, freerunning, and tricking, which are often considered "Extreme" Sports. In addition to the above mentioned, we also teach tumbling, break dancing (bboying/bgirling) martial arts, and other similar movement arts, and may make use of other specialists, contractors, employees, or people affiliated with BRM, in different fields of sports, disciplines, athletics, or specialties; these sports have inherent risk and must be practiced with extreme caution, as injury can be minor to severe or even catastrophic, resulting in death or dismemberment. Definitions: 1. Parkour is a movement discipline where you train to overcome obstacles in your environment by adapting your movement to your environment. 2. Freerunning, also called free running is similar to parkour but includes flips, tumbling, break dancing, and elements of tricking to make an aesthetically pleasing way of moving through an environment. 3. Tricking is a combination of tumbling, break dancing, and martial arts. It is practiced to make chains of "tricks" that form interesting ways to move and connect movements to each other in the form of tumbling passes, or tricking passes, using flips, kicks or other similar maneuvers. These sports carry risk ranging from minor to catastrophic including but not limited to death, dismemberment and impalement. Extreme is to be exercised at all times, however some of these risks are unavoidable.
By signing below, you are agreeing that you as the participant or signer for the underage participant(s) understand these sports and activities have high risks involved and can result in minor to severe injury as a result of the above mentioned activities and that while steps are taken to minimize risks, there is still unavoidable risk in all the above mentioned activities.
2) Safety rules, procedures and guidelines: For your safety and the safety of others, there are signs posted by or near the equipment displaying the safety rules and guidelines for safe equipment use. These signs are to be obeyed and followed carefully. Any willful violation of the safety rules and guidelines can result in your expulsion (temporary or permanent) from classes, events, or activities that BRM offers should the participant present themselves a safety risk to themselves, or others participating in BRM activities, events and so on. BRM also reserves the right to expel those who are deemed a safety hazard or risk to the gym, themselves and or others. Caution must be exercised while training. Listed below are the rules for the gym. By signing this document you are agreeing for yourself or the participant under the age of 18 years old, that you or they are aware of these rules and will follow them cautiously and with all seriousness, and will be subject to our rules.
* General Rules for the facility.
1. Respect yourself and your environment, safety of yourself and others is always first.
2. No admittance to this facility without supervision of an approved instructor of Blue ridge Motion.
3. Roughhousing of any kind is not permitted.
4. Master the basics first. Be patient.
5. You may not climb or be on anything higher than your own head height without direct instruction.
6. Always place mats under your training area, especially bars.
7. Always land feet first on the mats. If the situation doesn’t allow for you to land on your feet, land on your butt, back, or side, but never your head or neck.
8. Stay within your comfort zone. Parkour is about exploring your capabilities, take the time to correctly learn the skills that will make you a better mover for the rest of your life.
* Rules for the Bars.
1. Always use mats under the bars for landing.
2. Watch your surroundings. There are other people running around, and if you and or they are not paying attention, a collision of some sort is possible. Watch, Wait, Go.
3. Do not climb higher than your own body height without permission from Blue Ridge Motion Staff.
4. Safety First. If something doesn’t feel right, don’t do it! Attempting things you are not prepared for can be dangerous and result in serious injury. Ask a Coach if you are in doubt.
5. Be respectful. Remember you are working out with others, be sure to share and be respectful to each other. We are all here to have fun, which means we all must adhere to the rules.
* Rules for the Air Floor.
1. No SHOES. We want the floor to last as long as possible. so help us out, put your shoes away in the cubbies, or someplace out of the way by the floor.
2. No Sharp objects. Have a pocket knife or some sharp object? please remove them before using the floor so you don’t puncture it.
3. No solid obstacles on the air floor. The wood can have sharp points and puncture the air floor. You can use gym mats or padded boxes.
4. Be respectful and patient. Take turns and don’t crowd each other. Injuries can occur when performing skills at close proximity to each other.
5. Do not attempt to perform skills or movements you are not trained to perform, especially if you have difficulty performing them safely. If you want assistance, ask a coach.
I, the undersigned, understand, appreciate and agree with the information as listed here in section 2, for myself and or person of minority age and agree to comply with all posted safety rules and guidelines, for the protection of myself, and others, and understand that violation of the posted rules can result in MY or the minor I sign for expulsion (permanent or temporary) from any and ALL BRM activities, functions, events or classes, and furthermore assume the risks involved in disregarding these rules, and safety guidelines, especially when it results in injuries to myself or others.
3) Release of liability. Inherent risks: I, being the adult participant and or visitor, and or the parent or legal guardian of the participant(s) and or visitor(s), of minority age, recognize and understand that with the above mentioned activities and services offered by BRM, there is inherent risk involved; I, am aware that in addition to the usual dangers and risks inherent in the sports of gymnastics, tumbling, parkour/freerunning, tricking, martial art movements, martial arts, stretching, conditioning, exercising, personal training, and any other activities, classes, services, or programs that BRM offers, certain additional dangers and risks are present and UNAVOIDABLE when participating in any function inside or outside of our facility, including, but not limited to the following: misjudging distances or my own capabilities, misjudging the capabilities of others, performing tricks, flips, vaults, jumps, runs, tumbles, passes, or other similar activities and colliding with other participants, visitors, staff, passerby's, and or spectators. Being struck by falling person(s), object(s) or obstacle(s), being struck by other participants; landing poorly, slipping and or sliding on the floors, mats, ground, inflatables, or even on an object, obstacle or person when dry or wet, missing or bounding out of the landing area(s), slipping or "peeling off" on bars, running into obstacles and walls with your body, hitting limbs on equipment, mats, boxes, obstacles or other apparatus in the gym, hitting limbs on rails and bars, landing on your head, neck, back, butt, knees, ankles, elbows, toes, hands, face, shoulders, shins, thighs, groin, fingers, forearms, clavicle, jaw, or other parts of the body; carelessness of visitors, spectators, participants, spotters, and BRM staff; failure of BRM equipment or personal equipment, including obstacles and or mats that are damaged, broken, or not properly assembled; equipment misuse by myself, others, or those I signed for; health issues caused by heat, cold, allergies, over exertion, dehydration, self inflicted incidents whether accidental or intentional.
I understand that these risks create a risk of minor to more serious injury including but not limited to: muscle imbalance, cracked bones, bruised bones, dislocated bones or joints, jammed joints, broken bones, skull fractures, bone fractures, hairline fractures, concussions, bruises, sprains, muscle strain, muscle tears, tendon or ligament strain, tendon or ligament tears, skin abrasions, skin cuts and lacerations, skin tears, skin burns, torn callouses, splinters, broken or chipped teeth, eye damage, vision problems caused by flickering or low level lighting, lost vision, torn ears, biting off your tongue, breaking your nose, torn limbs, dismemberment, lost hearing, fingernail damage, toenail damage, lost fingernails, lost toenails, penetration of the body by foreign object(s) or obstacle(s), bleeding, damage to internal organs, rupture of internal organs, infection, nerve damage, stopped breathing, heart attacks, strokes, oxygen deprivation, brain damage, temporary and or permanent paralysis, and aggravation of disorders that could be or are specific to the me such as panic attacks, anxiety, depression, ADHD, ADD, Aggressive disorders and tendencies, and any other disorder whether diagnosed or not, and even in more serious cases complete catastrophic injuries resulting in death and or decapitation.
I am aware that the Activities and my interactions at the gym and or elsewhere are inherently dangerous and any of these aforementioned risks may result in such minor and or serious injuries, dismemberment and or death to myself and/or other persons at the gym. I acknowledge and understand that the risks described above are inherent in a visit to the gym and cannot be eliminated or avoided. I assume all the risks listed in this Section 3 and assume full responsibility for such risks to which I am willingly and voluntarily exposing myself or the minor I signed for. I accept full responsibility for any injury or death that may result from participation in any activity or class in or out of the gym locations, property, and all BRM functions, whether under the direction of BRM or otherwise. I, an adult visitor, and or participant and or parent/guardian confirm, affirm and guarantee that I have read every single word in this Section 3 and that I assume all the risks listed in this Section 3, for myself and or the child of minor age (17 or younger) I sign for, upon CONSIDERATION of provision of services from BRM.
4) By signing this waiver, I further freely accept and assume FULL responsibility for all such dangers, risks and possibility of personal or non-personal injury, dismemberment, permanent paralysis, death, or loss resulting thereof, whether stated in this document or not, for MYSELF, and or other visitor(s) and or participant(s) of minor age that I sign for and or am simply responsible for, also to waive ANY and ALL claims for personal or non-personal property damages, that I, my and or other participant(s) and or visitor(s), may have against BRM, it's owner, partner(s), director(s), Janitorial staff(ers) Office Staff(ers), officer(s), affiliate(s), agent(s), employee(s), staff(ers), contractor(s), representative(s), Landlord(s), Land owner(s), Facility owner(s), contributor(s), and any volunteer(s) that are working with BRM, volunteering, employed, or contracted, operating officially with BRM, all of whom are hereinafter collectively referred to as “the Releasees.” In consideration of participation in the BRM sports, movement programs, and special events, I the participant and or visitor, and or the parent or legal guardian of the participant(s) and or visitors, acknowledge, appreciate, and agree:
5) To release the Releasees, from any and all liability for any loss, damage, injury, permanent paralysis, death, medical or ANY expense that I, or others may suffer or that any other party may suffer as a result of my, or my participant(s) and or visitor(s), participation or non-participation in BRM's sports training programs, events, classes, seminars, and all other BRM services and functions, whether in the facility, outside of it, or in places we may train e.g. parks, campuses, and or public areas off facility grounds, whether the fault is my own, the visitor(s), someone I am responsible for, and or participant(s), or Releasees. I affirm I have read and understand this, and by my signing this document, I affirm and agree to have it legally binding on myself, and am assuming all the risk and testify this to be binding on all others that may seek claim for me, whether of family relation or not, pursuant to section 6.
6) This release of liability shall be effective and binding upon my heirs, next of kin, executors, administrators, successors, lawyers, familial relations, spouse(s), siblings, cousins, nieces, nephews, brothers, sisters, parents, mother(s), father(s), grand parent(s), great grand parent(s), children, grand children, or great grand children, insurance provider(s), insurance companies; their staff, lawyers, representatives, or others associated with the insurance company that covers me, and or my family, and any other parties trying to pursue legal action in any way against BRM or any of it's Releasees, affiliates, subcontractors, or related parties, and assigns in the event of my personal injury, death, permanent paralysis, illness and/or property damage.
7) Appropriate Conduct: I, the undersigning adult, agree for myself and or the minor I am signing for, that I, or they (the minor(s)), will not take unreasonable risks while participating in BRM functions, classes, activities, games, special events, boot camps, seminars, workshops, camps, summer camps, day camps, parties, birthday parties, indoor and outdoor events, functions and services offered by BRM and other Releasee activities, including but not limited to attempting skills, jumps, maneuvers, techniques, drops, flips, tumbles or tricks that I, or the participant/visitor of minor age, am not qualified to perform safely or causing any other participant(s), visitor(s) or spectator(s) unreasonable risk of harm. Furthermore, I agree to follow correct safety procedures, rules and guidelines when using BRM facilities, equipment, or taking advantage of BRM services and all Releasees activities in and away from the gym. If not followed, I, understand that it is BRM's right to refuse to offer services to me for any period of time given my, or my participant(s), visitor(s), or person(s) I am responsible for, violation of the rules, regulation, and safety guidelines. I further understand, that violating these guidelines, as well as posted safety regulations for equipment disqualifies myself and all others that may represent me as listed above in Section 6, to sue or pursue legal action on the grounds of your violation of our standards, safety guidelines and safety procedures.
I certify that I have read and understand this Release of Liability Waiver / visitor agreement document thoroughly, prior to signing it, and I am aware that by signing this Release of Liability Waiver I am waiving all legal rights which I or my heirs, assigns, personal representatives, next of kin, executors, administrators, successors, and assigns, may have against the BRM, or the Releasees. BRM shall have the right to impose any additional conditions which, in the opinion of the Releasees, will further the intent and legal rights and waivers provided herein. This Release of Liability Waiver was made and executed in the state of Virginia and shall be governed by, enforced in, and construed in accordance with the laws of the State of Virginia. I hereby consent to participating in programs at Blue Ridge Motion LLC (BRM) offered under consideration, as stipulated above and again affirm that I assume full responsibility and assumption of risk for myself, my participant(s), visitor(s) and person(s) I am responsible and or signing for.
Media Policy
I the undersigned, understand, appreciate and affirm that it is clear to me that BRM reserves the right to take photos, videos or audios of those participating in BRM Functions, classes or events, and is only authorized to use this media for marketing, promotional and advertising purposes for BRM functions and events on social media, and the gyms website, and will not otherwise sell or distribute this media for any other purpose other than to use for ads on facebook, google, instagram and or other advertising and social networking platforms to promote BRM and brand awareness and show what we do. BRM reserves the right to alter these pictures, audios, videos and other media to suit their needs at no cost to me, and retains all property rights to the content.
Payment policy and Authorization
I, the undersigned, have agreed to allow Brm, to charge my account and or submitted form of payment for classes, events, open gyms, parties, or other services, events and offers rendered or to be rendered by BRM and or their contractors, employees or staff and affiliates. I also agree to be subject to the terms of their auto pay policy (to be automatically placed on auto pay) and authorize them to withdraw late fees, sign up fees, deposits, tuition, event prices, and or other fees upon signing up for whatever option(s) I choose, and give them permission to charge the account for late fees or other fees, subject to their policies and procedures, should I fail to meet their requirements.
Medical Authorization. In the event of a minor injury (scratches, cuts, splinters, sprains, etc...) BRM staff will render basic first aid care; putting on bandaids, bandages, cleaning and dressing minor wounds, giving ice packs, wrapping ankles, and wrists etc, but will NEVER administer medications of any sort (prescription or over the counter such as ibuprofen, or other anti-inflammatory drugs) In the event of a more severe injury such as bone breaks or worse, BRM, in the absence of parent or legal guardians, will call emergency medical services for an ambulance on your behalf and will then make attempts to contact the necessary parties, and if not reached will continue to call and have a staff member accompany the participant to the hospital.
In the event that the injured is not conscious of breathing or has no pulse, CPR certified BRM staff will assume consent under the good Samaritan law and take appropriate action, rendering CPR, rescue breaths and or other emergency care until professional emergency care personnel arrive.
I, the undersigned, fully understand Blue Ridge Motion LLC (BRM), coaches, members and trainers are not physicians or medical practitioners of any kind. I hereby release BRM, and all it's staff (The releasees) its coaches, members and trainers to render basic first aid to myself, participant(s), visitor(s), and person(s) of minority age, that I am responsible for, as the undersigned adult, and or legal guardian, in the event of any injury or illness, especially in my or another legally responsible person's absence. I further grant permission to BRM Staff, that if deemed necessary by the BRM, staff, (releasees) to seek medical help, including the calling of an ambulance for said participant(s) in my or another legally responsible guardians absence. Lastly, I am fully aware of and appreciate the risks, including the risk of catastrophic injury, paralysis and even death and or dismemberment or decapitation, as well as other damages and losses that may occur while participating in BRM, activities. I FURTHER AGREE THAT BLUE RIDGE MOTION LLC (BRM, WITH ITS Releasees, EMPLOYEES, AGENTS, OFFICERS, VOLUNTEERS, ALL STAFF AND DIRECTORS, SHALL NOT BE LIABLE FOR ANY PERSONAL OR NON-PERSONAL INJURIES, LOSSES OR DAMAGES OCCURRING AS A RESULT OF BRM RELEASEES AND ANY OF THEIR ACTIVITIES, OR MY DIRECT, OR INDIRECT PARTICIPATION (FOR MYSELF OR THOSE I AM RESPONSIBLE FOR) IN BRM ACTIVITIES. I agree to notify BRM, or its representatives if I apprehend, believe or recognize that I, or the participant(s), visitor(s), or person(s) I am responsible for, cannot safely complete or does not understand any activity in which the participant, visitor, person, is asked, directed or instructed to participate in. I understand that this activity waiver and release of liability may be edited, revised or updated and that I may be required to execute a new one before continuing to participate in BRM, activities, programs and or services. I, lastly agree that I have read and understand all the above legal statements, and agree that my signature is effective and binding upon my heirs, next of kin, executors, administrators, successors, lawyers, and any other parties (and those as mentioned above) trying to pursue legal action in any way against BRM or any of it's Releasees, affiliates, subcontractors, or related parties, and assigns in the event of my personal injury including death, permanent paralysis, illness and/or property damage, and all other above mentioned possible injuries, minor or major.
I have read, understood and made clear everything I needed to know, and by signing this document am affirming I have read, understood and agree with the terms of this agreement and am assuming full responsibility for myself and or the participant I am signing for, and that I, and or others I am signing for will adhere to the rules and terms put down here on this document.
